We have an exciting opportunity for a Commercial Manager to join our commercial team.
This role is home based with travel as and when required.
Reporting to the Commercial Director, you will drive the commercial agenda within operational area of responsibility, ensuring that tight commercial management is in place across a number of operational contracts or a large contract, working alongside the Account Manager/Director and on-site team and in collaboration with functional teams.
Key Responsibilities will include:
Business as usual (BAU):
- Lead on the development and management of risk registers and any dispute management with suppliers and customers
- Provide assurances to the business that the commercial / contractual imperatives on the contract are being adhered to and that risks are being appropriately mitigated
- Advise on, and review the ongoing performance of suppliers to commercial terms at account and business level in collaboration with the Regional procurement function
- Lead the commercial position on material contractual disputes, working closely with the legal and operational team, laying out the recommended commercial strategy and leading the planning and execution of the commercial plan
- Commercial governance of G4S lifecycle account responsibilities across the PFI contract of responsibility
- Identify develop and collaboratively support profit improvement initiatives
- Negotiate to given boundaries solo or in conjunction with other stakeholders internally and externally
- Communicate outcomes and any operational or commercial actions to all stakeholders, ensuring any lessons learnt are captured.
- Own the commercial solution with regards to project delivery, ensuring that appropriate contractual arrangements are in place both upwards to the SPV/client and down through the subcontractor chain.
Mobilisation and Demobilisation:
- Advise on, and review the procurement and selection of suppliers at account and business level.
- Provide the commercial interface between G4S FM and Regional procurement function
- Ensure that all commercial aspects of the contract are understood by the contract team and that owned plans are in place for ensuring the successful commercial outcomes on the contract.
- Bidding/Variations/Project Works
- Attain a detailed understanding of the contractual documentation, working with business development, legal, operations, finance etc to ensure that the commercial terms are well understood and bid strategies are in place for dealing with risks and converting entitlements
- Manage and produce commercial cost models and commercial responses to required standards
- Gain G4S stakeholder approval to the commercial positions proposed, such as Group Legal and Senior Management and any external Advisors.
Commercial Close/Governance:
- Act as Commercial Lead to ensure commercial position and pricing/costs are established and risk mitigation strategy is clearly developed.
- Co-ordinate the contract’s commercial responses and ensure these closed off contractually on financial close
Re-bidding/Benchmarking/Market Testing:
- Ensure clear commercial strategy is in place for the re-bidding of a contract in collaboration with the business development and operational team
- Team leadership and development
- Provide leadership to team members and ensure clarity is provided on focus areas to deliver against the business and commercial objectives
- Work with individuals to understand their career aspirations and development areas, ensuring that they are provided with the coaching and support to enable them to position themselves for their next roles
The Ideal Candidate:
Essential Criteria:
- Degree level or equivalent
- Demonstrable commercial technical knowledge and experience
- Experience of NEC and Public Sector contracts – particularly PFI style contracts
- Proven ability to successfully negotiate on high “value at stake” issues
- Proven dispute resolution process experience
- A strategic thinker with strong commercial awareness, excellent interpersonal awareness and influencing skills and a target/profit driven attitude with a focus on delivering results
- Understanding of PFI Contract Payment Mechanisms
